North Carolina Increases Move Over Penalties to Class 3 Misdemeanor for Violations Causing Serious Accidents

North Carolina Senate Bill 29, signed by Governor Cooper in July 2019 and known as the Officer Jason Quick Act, increased penalties for Move Over violations that cause serious accidents to a Class 3 misdemeanor, effective December 1, 2019, according to attorney resources. The bill was named after Lumberton Police Officer Jason Quick, killed on I-95 in December 2018.

Operator takeaway

A Class 3 misdemeanor for a Move Over violation that causes a serious accident — bring this precedent to your state if your Move Over law treats a fatality as a traffic ticket.
