Huntsville's Tow-Yard Ownership Mandate May Conflict with Texas Regulatory Consistency Act, TowShark Reports

Towing companies that lost police rotation spots in Huntsville, Texas after the city required operators to own their storage yard under Ordinance 26-136 may have grounds to challenge the rule under the Texas Regulatory Consistency Act, which bars municipalities from imposing requirements in areas already governed by TDLR and the Occupations Code, according to a TowShark investigation. Six provisions of the ordinance may conflict with Chapters 2303 and 102A — the statutes that govern towing and VSF licensing statewide.
