202,345 CDL Holders Are in Prohibited Status in the FMCSA Clearinghouse — 79 Percent Have Not Started Return-to-Duty

More than 202,000 commercial driver's license holders are currently in prohibited status and unable to legally operate a commercial motor vehicle under the FMCSA Drug and Alcohol Clearinghouse as of January 2, 2026, with 159,226 of them having taken no steps toward the return-to-duty process, according to FreightWaves. Marijuana accounts for approximately 59 to 60 percent of all positive drug test violations in the database, and a separate FMCSA rule effective March 16 is simultaneously phasing out eligibility for an estimated 194,000 nondomiciled CDL holders.
